How Old Do You Have to Be to Buy Herbal Cigarettes in NZ? R18, Online Orders and Delivery
You are over 18, you have found an age-restricted herbal smoking product online, and you are ready to place an order. The obvious question is whether R18 only matters when you click checkout, or whether proof of age and the person who receives the parcel matter as well.
In New Zealand, both parts matter. The sale itself cannot be made to someone under 18, and a regulated product cannot later be delivered, or arranged for delivery, to someone under 18.
How old do you have to be to buy herbal cigarettes in NZ?
You must be 18 or over to legally buy herbal smoking products in New Zealand.
Herbal smoking products are included among the notifiable and regulated products covered by New Zealand's under-18 sale rules. That means the herbal cigarettes age limit NZ customers need to know is 18, even when the product contains no tobacco.
Where age matters from checkout to delivery
When you are ordering online
Ordering through a website does not remove the R18 requirement. An online retailer selling regulated products still has to comply with the rule against selling them to anyone under 18.
It is also important to separate the law from the Ministry of Health's recommended internet-sales practices. The law sets the age restriction. The Ministry then recommends practical measures retailers can use to reduce the risk of selling to minors. It does not say every retailer must use one particular piece of software or one identical verification process.
When age or identity is checked
For internet sales, the Ministry recommends meaningful age verification rather than relying only on a customer declaring that they are 18. Its current guidance says a simple tick box or statement that the customer is 18 or over is not sufficient as a defence under section 40 of the Act.
The Ministry recommends checking photographic proof of age. Approved evidence-of-age examples it identifies include:
- New Zealand driver licence
- Valid New Zealand or international passport
- Hospitality New Zealand 18+ card
- Kiwi Access Card
It also recommends checks or systems that help establish that the order name, shipping name and name on the purchasing card match. These are Ministry recommendations for internet retailers. They are not a statement that Healthy uses a particular upload, scanning, storage or ID-verification system.
Before the order is dispatched
Our current Honeyrose ready-made cigarette listing marks the product R18 and states that we cannot sell it to someone unless they are over 18.
Our current Honeyrose Farmers Blend listing goes one step further and states that proof of age will be requested before orders are dispatched.
That wording is specific to the current product listings. We do not want to turn it into a broader claim that every age-restricted order follows an identical internal process.
When the parcel is delivered
This is the part that is easy to miss. Under the current New Zealand rule, a regulated product that has been sold to a person of any age must not then be delivered, or arranged for delivery, to somebody under 18.
In everyday terms, being an adult purchaser does not make it lawful for an age-restricted herbal smoking product to be handed over to a minor. The age question does not stop once payment has been accepted.
The Ministry also recommends delivery methods that identify the correct customer and verify that person's age. Exact courier processes can vary, so we do not guess about specific handover, redelivery or depot procedures.
The buyer and the person receiving the parcel are two separate age questions
An online order can involve more than one person, so it helps to think about the buyer and the recipient separately.
If an adult places the order but a 17-year-old is the person available to receive the parcel, the recipient's age still matters. The rule against delivery to someone under 18 still applies.
If the purchaser and named recipient are different people, that can also create an identity and age-verification issue. Ministry guidance recommends checks that connect the order name, shipping name and purchasing-card name rather than treating each detail in isolation.
An adult also cannot make an under-18 sale or delivery acceptable simply by placing the order on behalf of the younger person. The R18 boundary still applies.
Likewise, somebody under 18 attempting to collect or receive an age-restricted delivery does not become eligible simply because the order was paid for by an adult.
Tobacco-free does not remove the R18 rule
Tobacco-free or nicotine-free status does not remove the age restriction that applies to herbal smoking products in New Zealand. The legal category includes herbal smoking products even though they contain no tobacco, so the same under-18 sale and delivery boundaries still matter.
Why R18 does not end at checkout
For us, R18 is not simply wording placed on a product page. The sale boundary matters, and the delivery boundary matters too.

We will not guess about the exact verification service used for a particular order, how any ID information is stored, whether every age-restricted product follows an identical internal workflow, or which courier checks will apply in a specific delivery. Your age as the purchaser does not remove the recipient-age rule. A regulated product must not be delivered, or arranged for delivery, to someone under 18.

No adult purchaser can be used to bypass the under-18 restriction. The sale and delivery rules are designed to stop regulated products being sold or delivered to minors.
What if the purchaser and shipping names are different?
